Hilton Cabinets hereby warrants that all cabinets / countertops manufactured and sold hereunder by Hilton Cabinets to the original consumer are free from defects in materials and workmanship for a period of one year. All claims for defective cabinets / countertops must be made in writing and must specify the defects present in the cabinets.

After Hilton Cabinets has had an opportunity to inspect the cabinets / countertops, they will, at their discretion, either replace defective cabinets / countertops or repair any defects in the cabinets / countertops. This warranty is conditional on the customer’s proper handling and usage after delivery. Notice of claim under this warranty must be given promptly, in no case later than ninety days (90) after it becomes known.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE REMEDY OF REPLACEMENT IS THE SOLE AND EXCLUSIVE REMEDY FOR HILTON CABINETS OBLIGATIONS ARISING FROM THE SALE OF ITS CABINETS. IN NO CASE WILL HILTON CABINETS BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE, including without limitation, costs of installation, removal or re-installation, damage to other property, loss of profits, loss of goodwill, or other economic loss, whether such incidental or consequential loss or damage is claimed is on account of breach of warranty, breach of contract, negligence, strict liability in tort, or any other legal theory.
